391—Orchard sharecropping is an agreement concerning trees whereby they are handed over to a worker to tend in return for a known, undivided share of the fruit.
392—Field sharecropping is an agreement whereby land is handed over to someone who cultivates it in return for a known, undivided share of the crop.
393—Each party is bound by what customary practice requires2 and by any stipulation that involves no uncertainty3.
394—If an animal is entrusted to another person to work with, with whatever is earned shared between them, this is permissible.

٣٩١- فالمساقاة عَلَى اَلشَّجَرِ: بِأَنْ يَدْفَعَهَا لِلْعَامِلِ، وَيَقُومَ عَلَيْهَا، بجزء مشاع معلوم من الثمرة.
٣٩٢- والمزارعة: بأن يدفع الأرض لمن يزرعها بجزء مشاع معلوم من الزرع.
٣٩٣- وَعَلَى كُلٍّ مِنْهُمَا: مَا جَرَتِ الْعَادَةُ بِهِ٢، وَالشَّرْطُ اَلَّذِي لَا جَهَالَةَ فِيهِ٣.
٣٩٤- وَلَوْ دَفَعَ دابة إِلَى آخَرَ يَعْمَلُ عَلَيْهَا، وَمَا حَصَلَ بَيْنَهُمَا: جاز.
