Manhaj al-Salikin wa Tawdih al-Fiqh fi al-DinAbd al-Rahman al-Sadi’

owes it1.

356—A personal suretyship2 is an undertaking to produce the opposing party in person3.

357—The Prophet—may Allah bless him and grant him peace—said: “The guarantor is liable.” 4

358—Both remain liable5, except when:

1—he fulfills what he undertook;

2—the holder of the right releases him; or

3—the principal is discharged.

Allah knows best.

(1) Shaykh Ibn Aqīl commented: A financial guarantee is a person’s undertaking to satisfy an obligation owed by another. The guarantor need not know the principal debtor. A guarantee may cover either a known or an unknown obligation, provided that the latter can ultimately be determined. (2) Shaykh Ibn Aqīl commented: *Kafāla* (personal suretyship) is a person’s undertaking to produce someone against whom a financial claim exists, not someone liable to a *hadd* punishment prescribed by Allah. If the surety guarantees that he knows the person, he is held to that guarantee. The surety is discharged if the person guaranteed presents himself or dies, or if the specific property guaranteed is destroyed. (3) Manuscript A reads: “his person.” (4) Reported by Abu Dāwud (3565) and al-Tirmidhī (1265), who said: “This is a *hasan* hadith.” Here, *zaʿīm* means a surety or guarantor, while *gharāma* means paying what one has guaranteed or undertaken as surety. (5) The Shaykh held that the creditor may not demand payment from the guarantor until he is unable to recover it from the debtor, unless otherwise stipulated. The prevailing custom was that the guarantor could be pursued for the claim even when recovery from the debtor remained possible, for “believers are bound by their conditions.” *Al-Mukhtārāt al-Jaliyya*, p. 82.
