Manhaj al-Salikin wa Tawdih al-Fiqh fi al-DinAbd al-Rahman al-Sadi’

Chapter on Pledges, Guarantees, and Personal Suretyship

347—These are means of securing established rights.

348—A pledge1 is valid over any item of property that may validly be sold2.

349—The pledged property thus remains a trust in the possession of the pledgee3, who is not liable for it unless he transgresses

(1) *Rahn* (pledge) linguistically means permanence. Technically, it means securing a debt with an item of property from which the debt may be recovered, either directly or from its sale proceeds. (2) The Shaykh held that a pledge may consist of any tangible property, debt, or usufruct. If the pledgor consents to any of these—since the right belongs to him—whatever the two parties mutually agree upon becomes binding. *Al-Mukhtārāt al-Jaliyya*, p. 80. (3) The *rāhin* (pledgor) is the debtor who provides the pledged property, while the *murtahin* (pledgee) is the creditor who receives it.
