Manhaj al-Salikin wa Tawdih al-Fiqh fi al-DinAbd al-Rahman al-Sadi’

6—He also said: “Whoever cheats us is not one of us.” Reported by Muslim.1

325—The following are likewise tantamount to outright usury:

A—Circumventing its prohibition through an ʿīnah transaction, whereby a person sells an item for one hundred on deferred payment, then buys it back from the purchaser for less in cash—or the reverse.2

B—Using a stratagem3 to roll over a debt.4

C—Using a loan5 as a stratagem to engage in usury, by lending him

(1) Narrated by Muslim (no. 102). (2) This is what is meant by the prohibition against two sales in one transaction, as the shaykh established in *al-Mukhtārāt al-Jaliyya*, p. 72. (3) In “B, T”: *bil-tahayyul* (“through a stratagem”). (4) For example: “One person may be owed a debt by another. When it falls due, he says: ‘Either pay your debt, or go to so-and-so, who will extend credit to you, and then pay me.’ The first and second creditors have a prior agreement that each will extend credit to the other’s debtor, enabling him to repay his creditor; the debt is then reinstated against him so that he can repay the new creditor. Alternatively, he says: ‘Go to so-and-so, borrow from him, and pay me.’ The first creditor and the lender have an agreement, or something resembling an agreement, that the lender will lend to the debtor. Once the first creditor has been paid, the debt is rolled over against the debtor, who then repays the lender what he borrowed. This is a three-party stratagem for rolling over a debt.” End quote. Quoted verbatim from Shaykh Ibn Uthaymīn’s treatise *al-Mudāyanāt* (Credit Transactions), p. 15. (5) In “B, T”: *bil-qard* (“by means of a loan”).
