315—This includes:
1—The sale of a runaway slave2 or an escaped animal.
2—Saying, “I sell you one of these two items.”
3—Selling an area of land extending as far as a pebble reaches, or similar transactions.
4—Selling whatever one’s female slave or tree may bear.
5—Selling what is in the womb of a pregnant female3.
This applies whether the uncertainty concerns the price or the item sold.
316—[THE THIRD CONDITION]:
That the contracting party own the item (or be authorized to transact concerning it) 4 and be an adult of sound judgment.
(1) Narrated by Muslim, no. 1513.
(2) An *ābiq* is a slave who has fled his master.
(3) The shaykh held that concealed goods—such as musk still inside its sac, or radishes and similar produce still in the ground—may, according to the correct view, be sold if their sale entails no manifest *gharar* (contractual uncertainty). If it entails manifest *gharar*, the correct view is that their sale is prohibited. See *al-Mukhtārāt al-Jaliyya*, p. 71.
(4) The phrase “or be authorized to transact concerning it” is absent from “B” and “T”; both read: “or have legal authority over it.”

١- بَيْعُ اَلْآبِقِ٢، وَالشَّارِدِ.
٢- وَأَنْ يَقُولَ: بِعْتُكَ إِحْدَى اَلسِّلْعَتَيْنِ.
٣- أَوْ بِمِقْدَارِ مَا تَبْلُغُ اَلْحَصَاةُ مِنْ اَلْأَرْضِ وَنَحْوِهِ.
٤- أَوْ مَا تَحْمِلُ أَمَتُهُ أَوْ شَجَرَتُهُ.
٥- أَوْ مَا فِي بَطْنِ اَلْحَامِلِ٣.
وَسَوَاءٌ كَانَ اَلْغَرَرُ فِي اَلثَّمَنِ أَوْ الْمُثَمَّن.
٣١٦-[اَلشَّرْطُ اَلثَّالِثُ] :
وَأَنْ يَكُونَ اَلْعَاقِدُ مَالِكًا لِلشَّيْءِ (أَوْ مأذونًا له فيه) ٤ وهو بالغ رشيد.

٣ قرر الشيخ، أن الأشياء المستترة كالمسك في فأرته، والفجل ونحوه في أرضه، إن كان ليس فيه غرر بَيِّن، فالصواب قول المجوِّزين لبيعه، وإن كان فيه غرر ظاهر فالصواب قول المانعين. "المختارات الجلية، ص: ٧١".
