Minhāj al-ṬālibīnAn-Nawawi

or by giving it away anew, by manumitting it, or—according to the soundest view—by having intercourse with a female slave who was the gift.

No descendant other than an ascendant may retract a gift that was expressly conditioned on there being no counter-gift (thawāb).

Whenever a gift is made without qualification, no counter-gift is required if the recipient is of lower status; the same ruling—on the more reliable view—applies when the recipient is of higher status, and, according to the school’s preferred position, when he is a peer. Should a counter-gift nevertheless become obligatory, then on the soundest view it must equal the market value of the item originally given. If the recipient fails to furnish it, the donor is entitled to retract his gift.

If the donor stipulates a specific counter-gift, the preponderant opinion is that the contract is valid and, on the soundest position, it is treated as a sale. If the stipulated recompense is left undefined, the transaction is invalid according to the school.

If someone sends a present in a container, then if custom does not require the container to be returned—as with a palm-leaf basket of dates—the container itself counts as part of the gift; otherwise it does not, and it is impermissible to use the container for any purpose except, where custom so dictates, to eat the gift from it.
