finds one view to be more compelling is obliged to adopt it.
Al-Qurṭubī said, “Saʿīd ibn al-Musayyab, along with others, held that a divorce issued during menstruation does not take effect, because it is contrary to the Sunnah.” End of quotation (17/151) from al-Qurṭubī’s Tafsīr.
4 – They also claim that he rejects making up a prayer deliberately abandoned. The reply is that the Shaykh’s own words in Majmūʿ al-Fatāwā (22/103) on this point are: “As for one who knew the prayer was obligatory yet left it, without any interpretive excuse, until its appointed time expired, he must make it up according to the four Imams. A group—among them Ibn Ḥazm and others—held that performing it after its time is not valid for such a person; they said the same of someone who willfully omitted fasting. Allah knows best.” End of quote.
Al-Ḥāfiẓ said in Fatḥ al-Bārī (=1/71), commenting on the ḥadith, “Whoever forgets a prayer should pray it when he remembers; there is no atonement for it other than that”: “Those who argue that the deliberate offender does not make up the prayer relied on its implicit meaning, for the absence of the condition entails the absence of that which is conditioned, so whoever did not forget does not pray.” End of quote.
Thus, the Shaykh merely reported the divergence of opinions; the matter is open to legitimate scholarly dispute and is not an area of consensus. Allah knows best.
If, after weighing the evidence, he adopts the view that no make-up is required, there is no blame upon him. The Shaykh also said in Majmūʿ al-Fatāwā (22/18–19): “People have differed regarding the one who deliberately abandons prayer or fasting—must he make it up? Most say that he must, while some say he does not and that performing it after its time is invalid, just like ḥajj…” End of quote. He went no further than relating the disagreement.
5 – They further allege that he said a person who denies consensus is neither an unbeliever nor an evildoer. This is a lie about the Shaykh—may Allah sanctify his soul—for he reveres consensus and urges adherence to it.
