If, however, those who espouse the Khawarij doctrine remain within the imam’s control and do not break their pledge of obedience, they are not to be fought, and the ordinances of Islam continue to apply to them. They must, nevertheless, be subjected to discretionary punishment, openly rebuked, and prevented from publicizing their views or spreading their innovation among the Muslims.
This ruling follows the opinion—held by the majority—that does not declare them unbelievers. According to those who do consider the Khawarij to be disbelievers, fighting them is obligatory in every case.
