Slaves, the impoverished, minors, the mentally unsound, women, and anyone whose religion differs from that of the killer are not counted among the ʿaqilah, for such individuals are not in a position to give help or share the burden.

The blood money for accidental killing is to be paid by the ʿaqilah over the course of three years. The judge should apportion to each member only what he can manage, beginning with the nearest relatives and then moving to those further removed.

Shaykh al-Islam Ibn Taymiyyah (d. 728 AH) said, “The indemnity is not to be deferred for the ʿaqilah if the ruler deems immediate payment to be in the public interest ….” End quote.
