When each spouse claims that the other has wronged him or her and reconciliation between them is no longer feasible, the judge appoints two upright arbiters from their respective families, for relatives are better acquainted with hidden motives and more likely to act faithfully and in the couple’s best interests. Both arbiters must seek reconciliation, as Allah, the Exalted, says: “If you fear a breach between them, appoint an arbiter from his people and an arbiter from hers. If the two desire reconciliation, Allah will bring harmony between them. Indeed, Allah is All-Knowing, All-Aware” (Q 4:35). The arbiters may choose whatever is most beneficial—whether keeping the marriage intact or dissolving it, with compensation or without—and whatever decision they reach is to be implemented, thereby resolving the dispute. Allah knows best.
