al-Moulakhas al-FiqhiSalih Al-Fawzan

Condition 2: that no entitled descendant of a higher generation be present apart from the daughter who has already received one-half, for the granddaughter is only entitled to one-sixth when that daughter exists.

A paternal sister, when inheriting alongside a full sister, likewise receives one-sixth to complete the two-thirds. The evidence for this is the consensus of the scholars, as several authorities have transmitted, and by analogy with the granddaughter inheriting together with the direct daughter. Yet the paternal sister does not obtain that one-sixth except under two further conditions:

Condition 1: she must be accompanied by a single full sister who receives the fixed one-half. If there are two or more full sisters, they exclude the paternal sister because their own shares already add up to the two-thirds.

Condition 2: she must have no agnatic brother who would make her a residuary—that brother being her paternal brother. If he is present, then whatever remains after the full sister’s share goes to the two of them by agnatic succession, the male receiving twice the share of the female. And Allah knows best.
