al-Moulakhas al-FiqhiSalih Al-Fawzan
  1. He is entitled only to agnatic succession when the deceased leaves neither a child nor a male-line grandchild.

  2. He takes both the fixed one-sixth and whatever remains as a residuary share when the heirs consist solely of female descendants—whether daughters or granddaughters through a son.

The paternal grandfather occupies the same position as the father in these three situations, for the scriptural texts encompass him whenever the father is lacking. Yet the grandfather differs from the father in a fourth situation: when full or paternal half-siblings exist alongside him. Here the jurists have differed. One view holds that the grandfather, like the father, precludes the siblings entirely; another maintains that he does not bar them but rather shares the estate with them, being considered one of them, so they divide the remainder—or whatever the fixed shares leave—according to methods set out in this chapter. The reasoning is that the grandfather and the siblings are equal in their connection to the deceased through the father: the grandfather is the father’s father, while the siblings are the father’s children, and therefore they should be equal in inheritance. This was the position adopted by a group of Companions such as ʿAli, Ibn Masʿūd, and Zayd b. Thābit, and it is the view of Imams Mālik and al-Shāfiʿī as well as the two students of Abū Ḥanīfah, and it is the well-known opinion attributed to Aḥmad. They cite numerous scriptural proofs, arguments, and analogies, detailed in the longer works.

The second view is that the grandfather excludes the siblings just as the father excludes them. This was espoused by Abū Bakr al-Ṣiddīq, Ibn ʿAbbās, and Ibn al-Zubayr, and is reported from ʿUthmān, ʿĀʾishah, Ubayy ibn Kaʿb, Jābir, and others. It is also the opinion of Abū Ḥanīfah, a narration from Aḥmad, and was preferred by Shaykh al-Islām Ibn Taymiyyah, Ibn al-Qayyim, and Shaykh Muḥammad ibn ʿAbd al-Wahhāb—may Allah have mercy on them all. They advance many evidences, and this view is closer to what is correct. Allah knows best.
