the fruit, repairing the water channels, and distributing the water to the trees.

The owner of the trees, on the other hand, is responsible for preserving the capital asset—the trees themselves—by digging the well, constructing protective walls, ensuring that water is available in the well, and the like. He must also procure whatever materials will strengthen the trees, such as fertilizer and similar additives.

Supplying the seed along with the land is not a condition for the validity of a muzāraʿah (share-cropping) contract. Should the owner hand over only the land while the worker provides seed from his own resources, the contract is sound. This is the position of a number of the Companions, it is the prevailing practice, and it is supported by the hadith in which the Prophet ﷺ contracted with the people of Khaybar for half of what the land produced; that report contains no indication that the seed was to be supplied by the Muslims.

Imam Ibn al-Qayyim (d. 751 AH) said: “Those who require the seed to come from the landowner have compared muzāraʿah to muḍārabah (capital-profit partnership). Besides contradicting the sound Sunnah and the statements of the Companions, this is one of the most unsound analogies: in muḍārabah the capital returns to its owner and the two parties simply divide the profit; this is analogous to the land in muzāraʿah. As for the seed, whose like does not return to its owner but perishes just as the benefit of the land perishes, it is more fitting to liken it to the perishable asset than to the enduring one.” End quote.

The term muzāraʿah is derived from zaraʿ (cultivation). It is also known as mukhābarah and muwākarah, and the worker in such an arrangement is called a muzāriʿ, mukhābir, or muwākir.

The legitimacy of muzāraʿah rests on the sound Sunnah, as already mentioned, and genuine need demands its permissibility: some people own farmland yet are unable to cultivate it, while others are able to farm but do not own land.
