The profit of a muḍāraba is not to be divided before the contract has been brought to an end unless both parties expressly agree, for profit safeguards the principal. There is always the possibility that a portion of the dealings will incur a loss that must be covered out of that profit. Should the profit be distributed while the muḍāraba remains in force, no reserve would be left to absorb any subsequent loss. Accordingly, profit is a buffer for the capital, and the worker is not entitled to any share of it until the principal has been fully preserved.
The worker is a trustee; he must fear Allah in the responsibilities he has been given. His statement is accepted regarding any claim of damage or loss, and he is to be believed when he says that he bought something for himself rather than for the muḍāraba, or for the muḍāraba rather than for his personal account, for he is trusted in these matters. Allah knows best.
