if he did not collect it, whereas an agent commissioned to purchase delivers the price, for that is part and parcel of the transaction and its attendant rights. An agent appointed solely for litigation is not empowered to take receipt, while an agent appointed to receive payment may litigate, for the money cannot be obtained except through that avenue.
Liability of the agent—what he must guarantee and what he need not
The agent is a trustee; he is not liable for any loss that occurs in his possession as long as he is neither negligent nor has he overstepped the bounds. If he is negligent, transgresses, or, when asked for the property, refuses to hand it over without a valid excuse, he becomes liable.
The agent’s statement is accepted—in the matters for which he was commissioned, whether sale or lease—that he has received the price or the rent and that they were subsequently lost while in his custody; his word regarding the amount of the price and the rent is likewise admissible. Allah knows best.
