Iqtiḍāʾ al-Ṣirāṭ al-MustaqīmIbn Taimiya

Nor do we recognize Ibn Rukānah. Even so, the weakness of the transmission does not prevent one from drawing support from this ḥadīth and citing it as corroborative evidence. It clearly shows that the Lawgiver wants the Muslim to differ from the polytheist in matters of dress—just as the Prophet said, “The line that separates what is lawful from what is unlawful is the daff (hand-drum) and the voice.” This distinction must be made outwardly, for the difference in belief and practice already exists without the turban; if an external distinction were not also required, the ḥadīth would be pointless. The same principle applies to the differentiation the Law commands between men and women, which is likewise mandated in outward appearance

(1) See Sunan al-Tirmidhi, Book of Dress, chapter “Turbans over Skullcaps,” ḥadīth no. 1784 (4:247). Tirmidhi adds the remark, “This ḥadīth is ḥasan gharīb,” and after the name Abū al-Ḥasan he writes the nisbah “al-Asqalānī” (4:248), as noted above. (2) In manuscript A an extra phrase reads “without the turban.” This is a copyist’s confusion, for the same words are then omitted from their proper place two lines later. (3) The printed edition inserts the heading “Section: Likewise in Tirmidhi (3:398).” (4) Al-Tirmidhi records the report in the Sunan, Book of Marriage, chapter “Publicising the marriage,” on the authority of Muḥammad b. Ḥāṭib al-Jumaḥī, ḥadīth no. 1088 (3:398). He grades it ḥasan and notes corroborating reports from ʿĀʾishah, Jābir, and al-Rubayyiʿ bint Muʿawwidh. The ḥadīth is also found in Aḥmad, Musnad (3:418; 4:77); Ibn Mājah, Book of Marriage, chapter “Publicising the marriage,” no. 1896 (1:611); and al-Nasāʾī, Book of Marriage, chapter “Publicising the marriage with vocal proclamation and beating the duff” (2/6/127) with the commentary of al-Suyūṭī and the marginal notes of al-Sindī. (5) The phrase “without the turban” is missing from manuscript A—its scribe had already inserted it two lines earlier, as mentioned. (6) Manuscript Ṭ reads: “of men and women.” (7) The word lamā is absent from manuscript A.
