Likewise is his ﷺ saying: “When a judge exercises ijtihād and reaches the correct verdict, he receives two rewards; and if he exercises ijtihād and errs, he still receives one.” Many other reports bear the same meaning.
Should you treat this as a separate category, the forms of disagreement would come to three.
The second category of disagreement mentioned in the Book of Allah is the one in which one of the two groups—the believers—is praised while the other is condemned, as in His words: “Those Messengers—We favored some of them over others…” (al-Baqarah 2:253) up to His saying:
(1) The printed edition reads: “he said, and he did not hit the mark” in place of “and he erred.”
(2) This hadith is agreed upon in the wording: “When a judge exercises ijtihad and reaches the correct ruling, he receives two rewards; if he exercises ijtihad and errs, he receives one reward.” See: Sahih al-Bukhari, Book of Holding Fast to the Sunnah, chapter “The reward of the judge who strives and is right or wrong,” hadith no. 7352 (Fath al-Bari, 13:318); Sahih Muslim, Book of Judgments, chapter “Clarifying the reward of the judge who strives and is right or wrong,” hadith no. 1716 (3:1342).
(3) The phrase points to ikhtilaf tanawwuʿ (a difference of variety) in which each of the differing views can be correct.
(4) As the author explains, the three categories are: (a) cases in which both contending parties are blameworthy—this is a difference of variety and constitutes the first category; (b) cases in which one of the two parties is blameworthy while the other is praiseworthy—this is a difference of opposition and is the second category; (c) cases in which both parties are praiseworthy—the third category.
(5) The phrase “and he criticized the other” is missing from manuscript B.
(6) The printed edition merely lists the verse without quoting it.
{تِلْكَ الرُّسُلُ فَضَّلْنَا بَعْضَهُمْ عَلَى بَعْضٍ}
(٦)
