Zād al-MustaqniʿAl-Hajjawi

—someone who had intended to fast while traveling, the fast is broken and no expiation is due.¹

If a person has intercourse on two separate days—or repeats the act within a single day—without yet offering the expiation, one expiation is required for the second occurrence while two are required for the first. If he has intercourse, performs the expiation, and then has intercourse again² on the same day, a second expiation becomes obligatory. The same applies to anyone who was already under obligation to abstain from eating and drinking and nevertheless has intercourse. Should a person have intercourse while healthy and then fall ill, lose sanity, or embark on travel, the duty of expiation is not lifted.

Expiation is incurred only for intercourse during a Ramadan fast. It consists of freeing a slave; if that is not possible, fasting two consecutive months; if unable to do so, feeding sixty needy persons; and if he lacks even that, the expiation is waived.

(1) The word kana (was) is missing from the M and J manuscripts. (2) The phrase thumma jama‘a fi (then he cohabited in/with) is absent from the B manuscript.
