Chapter on Taʿzīr (Discretionary Punishment)
Taʿzīr is disciplinary in nature and becomes obligatory for every act of disobedience that carries neither a fixed ḥadd nor an expiation. Examples include illicit sexual gratification for which no ḥadd has been prescribed, theft that falls short of the threshold for amputation, bodily harm that does not entail retaliation in kind, a woman having sexual relations with another woman, slander that does not involve an accusation of fornication, and similar offenses.
The taʿzīr penalty must not exceed ten lashes. Whoever masturbates with his hand without a legitimate⦗1⦘ need is to be disciplined.
(1) This is the reading found in manuscripts A and B; manuscript M has min ghayr, while al-Muqniʿ reads li ghayr.
