Chapter: The Prescribed Penalty for Adultery
If a muḥṣan (a legally married person whose marriage has been consummated) commits adultery, he or she is stoned to death. A person is deemed muḥṣan when he has had intercourse with his wife—whether she is Muslim or a dhimmī⦗1⦘—within a valid marriage contract, and both spouses were adults, of sound mind, and free. If any one of these conditions is lacking for either party, neither of them is considered muḥṣan.
