Chapter on the ʿāqilah and the liabilities it bears1
A person’s ʿāqilah consists of all his male agnates, whether related by blood or by walaʾ, near or distant, present or absent, including his two direct ascendants. No ʿaql is charged to a slave, someone lacking legal competence, a pauper, a woman, or anyone who does not share the offender’s religion.
The ʿāqilah is not liable for a homicide that is purely intentional, for an injury caused by a slave, for a settlement, for an admission of guilt that they have not endorsed, or for anything less than one-third of the full diyah.2
(1) Manuscript M reads: tahmil.
(2) The word al-tamma is crossed out in manuscript A, yet it appears in all the other copies.
