Chapter: What Triggers Retaliation for Injuries Short of Homicide
Whoever is liable to retaliation for killing someone1 is likewise liable for maiming a limb or inflicting a wound; and whoever is exempt in homicide is exempt here as well. Retaliation is incurred only on the grounds that make it due in cases of intentional homicide, and these are of two kinds:
- Injuries to limbs: an eye for an eye, a nose2 for a nose, an ear for an ear, a tooth for a tooth, an eyelid for an eyelid, a lip for a lip, a hand for a hand, a foot for a foot, a finger for a finger, a palm for a palm, an elbow for an elbow, a penis for a penis, a testicle for a testicle, a buttock for a buttock, and a labium for a labium—each3 of these is requited in kind.
Retaliation for limb injuries is subject to the following conditions:
(1) In manuscripts B and C the word at this point is unclear; I conjecture it to read “bihi” (with it).
(2) Manuscript C omits the phrase: “and the nose.”
(3) Manuscript B adds the word: “that.”
