Section: Conditions for Retaliatory Execution (qiṣāṣ)
They are four: 1) the victim’s legal inviolability (ʿiṣmah). Thus, were a Muslim or a protected non-Muslim to kill a combatant unbeliever or an apostate, neither qiṣāṣ nor diyah is incurred.
-
Legal accountability (taklīf); therefore no retaliatory execution is taken from a minor or an insane person.2
-
Equivalence (mukāfaʾah): the assailant must match the victim in religion, freedom, and slave status. Hence a Muslim is not executed for killing a non-Muslim, nor a free man for killing a slave, while the reverse does apply, and a male is put to death for killing a female,
(1) Manuscript M inserts: “one of them.”
(2) Manuscript M reads: “nor an insane person.”
