Chapter: Divorce Stated in the Past or the Future

If a husband says, “You are divorced—as of yesterday,” or, “before I married you”⦗4⦘, and he does not intend the divorce to take effect fi al-ḥāl (immediately), no divorce occurs. Should he have meant a prior divorce already pronounced by Zayd—one that could in fact have taken place earlier—then, if he dies, loses his sanity, or becomes mute before clarifying what he intended, she is not divorced.

(4) In copy “B” the wording reads: “I marry you.”
