Chapter on Acknowledging an Additional Heir
If all the heirs—even if there is only one of them—declare that someone is an heir of the deceased, and that person either confirms the declaration1 or is a minor or mentally incapacitated while of previously unknown parentage, his lineage and right to inherit are thereby established.
If one of the deceased’s two sons acknowledges another brother of equal status, that brother receives one-third of the share in the acknowledger’s possession; and if he acknowledges a sister, she receives one-fifth of it.2

(1) The B and M manuscripts read: “wa-saddaqa,” and the J manuscript likewise has “wa-saddaq.” (2) Shaykh Ibn Maniʿ notes that another copy reads: “bi-bint” (“with a daughter”).
