Chapter on the Inheritance of a Divorced Woman

If a man pronounces an irrevocable divorce against his wife while he is in sound health, or during an illness not feared to be fatal1 and later dies from it, or during an illness that is feared to be fatal2 but from which he ultimately recovers, neither spouse inherits from the other—except in the case of a revocable divorce whose waiting period (ʿiddah) has not yet expired.

However, if he irrevocably divorces her during a fatal illness in which he is suspected of intending3 to deprive her of her share, or if, while healthy, he makes her irrevocable divorce contingent upon his falling ill—or upon some act of his that he then performs during that fatal illness4 or anything similar—he may not inherit from her, whereas she inherits from him both during her waiting period and after it, provided she has not remarried or apostatized5.

(1) MSS B and M read: “his non-fatal illness.” (2) MS B reads: “his fatal illness.” (3) MS A: “he intends.” (4) MS A has “illness,” while MS J adds “fatal.” (5) The phrase “or she apostasizes” appears as an addition in MS B and in the commentary.
