Chapter on the Inheritance of Those Who Perish Together
When two individuals who would have inherited from one another—such as two brothers sharing the same father—die in the same incident, whether in a building collapse, by drowning, while abroad, or in a fire¹, and it is unknown (and uncontested) which of them died first, each is deemed to inherit from the other only with respect to the property he originally possessed. Whatever either would have inherited from his counterpart is excluded, so as to prevent a circular transfer of estates.
(1) The manuscript labelled “J” omits the words “or fire.”
