And the child both inherits and may be inherited from if, after birth, he cries aloud, sneezes, weeps, suckles, breathes for a measurable span, or any other unmistakable sign of life is observed apart from mere motion or convulsion 1.
If only part of the infant leaves the womb, he then cries and dies before the rest of his body is delivered, he does not inherit.
When twins are born and it is unclear which one cried—and their respective shares would differ—the matter is resolved by drawing lots.
The khunthā mushkil (indeterminate intersex) receives one-half of a male’s share and one-half of a female’s share.

It was later inserted in the margin by a different hand, which then added: “In brief: beginning with the chapter on the inheritance of a divorced woman, three chapters have been misplaced.” Yet in the original we do find, immediately before that chapter, the following sentence: “A Muslim, whether by blood relationship or by marriage, does not inherit from an original unbeliever, nor does any unbeliever or apostate inherit from a Muslim under any circumstance; if he dies persisting in his apostasy, his property becomes fay (public treasury revenue).” I have not located this passage elsewhere in the work and do not know where the copyist obtained it.
ويرث ويورث إن استهل صارخا أو عطس "أو بكى" أو رضع أو تنفس "وطال زمن التنفس" أو وجد دليل حياته غير حركة واختلاج١ وإن ظهر بعضه فاستهل ثم مات وخرج لم يرث وإن جهل المستهل من التوأمين واختلف إرثهما يعين بقرعة.
والخنثى المشكل يرث نصف ميراث ذكر ونصف ميراث أنثى.
