Zād al-MustaqniʿAl-Hajjawi

Section

A guarantee (kafāla) is valid for any item whose possessor is legally liable for it, and for the person of one who owes a monetary debt—never, however, for someone facing a prescribed ḥadd punishment or retributive qiṣāṣ. The only consent required is that of the guarantor, not that of the person on whose behalf the guarantee is offered.1 If the debtor dies, the item perishes through an act of God, or the debtor surrenders himself, the guarantor is absolved.

(1) In manuscript B the reading is lahu ("for him"), whereas manuscript J has al-makful ("the guaranteed party").
