is carried out on the basis of that admission only after the pledge has been released—unless the pledgee confirms it.
Section
The pledgee may ride any pledged animal that is normally ridden and may milk any that are normally milked, in proportion to what he spends on their upkeep, and he does not need prior permission to do so.
If he incurs expenses for the pledge without the pledgor’s authorization at a time when such authorization could have been obtained, he has no right to reimbursement. If obtaining permission was impossible, he may be reimbursed even though he did not seek the judge’s leave. The same ruling applies to a wadiʿa (deposit), an ʿāriyya (loan for use), and to hired beasts whose owner has fled.
Should the pledged property fall into disrepair and the pledgee restore it without permission, he may recover only the cost of the materials he used.
