Zād al-MustaqniʿAl-Hajjawi

—it is impermissible1, unless he intends it as a recompense or wishes to credit it against the debt. If he borrowed specie and the lender demands repayment in another town, the borrower must settle it there; and for any commodity whose transport entails expense, he owes its market value—so long as that value is not lower in the town where repayment is demanded2.

(1) The manuscript designated “J” omits the phrase: “lam yajuz” (it is not permissible). (2) Al-Bahuti states in al-Rawd that the correct wording is “azhar” (the preponderant view); see also al-Insaaf, vol. 12, p. 355, and al-Salsabil, vol. 2, p. 66.
