Chapter on Conditions in Sales
Some conditions are valid: stipulating a specific pledge, deferring the price, requiring that the slave be literate, a eunuch, or a Muslim, or that the female slave be a virgin; likewise, the seller may stipulate the right to live in the house for a month or that the camel be transported to a designated place. The buyer, for his part, may stipulate upon the seller⦗1⦘ to carry the firewood, split it, sew the garment, or tailor it. If two such conditions are combined, the sale is void.
Other conditions are invalid and render the contract void, such as when either party makes the sale dependent on another contract—whether a salam advance sale, a loan, another sale, a lease, or a currency exchange.
(1) In manuscripts B and M, the reading is shart (condition).
