Dalīl al-ṬālibMarʿi al-Karmi

If he says, “By Allah, may I never again see you entering So-and-so’s house,” intending thereby to forbid her, and she does enter it, he has broken his oath even if he never actually saw her.

Section

When no specific intention is formed, the ruling reverts to the cause that prompted the oath. Thus, if someone swears, “I shall certainly pay Zayd his due tomorrow,” and then pays him before tomorrow; or, “I will not sell this item except for one hundred,” and then sells it for more; or, “I will not enter that town because of the injustice found there,” and the injustice is removed and he then enters; or, “I will not speak to Zayd because he drinks wine,” and he later speaks to him after Zayd has given it up—he has not broken his oath in any of these cases.

Section

If both intention and cause are lacking, the ruling turns on the explicit designation. Accordingly, whoever swears, “I will not enter this house of so-and-so,” and then enters it after so-and-so has sold it, or after it has become an empty lot; or says, “I will not speak to this boy,” and he grows into an old man and he speaks to him1; or says, “I will not eat these fresh dates,” and they dry into ordinary dates and he eats them—he has broken his oath in every instance. If both intention and cause are lacking, the ruling turns on the explicit designation. Thus, whoever swears, “I will not enter this house of so-and-so,” and then does enter it after it has been sold, or after it has become an empty lot; or says, “I will not speak to this boy,” and he grows old and he speaks to him; or says, “I will not eat these fresh dates,” and they turn into dried dates and he eats them—he has broken his oath in all of these instances.

When intention, cause, and specific designation are all absent, reference is made to the scope of the term itself, which is of three kinds: legal usage, customary usage, and linguistic usage.
