Chapter on Ritual Slaughter (dhakāh)

Ritual slaughter consists in cutting the throat or performing nahr—piercing at the base of the neck—of an animal over which one has control.

Its conditions are four:

First: the person performing it must be sane, discerning, and intentionally undertaking the act of ritual slaughter.

Accordingly, slaughter carried out by a woman, a slave, someone in a state of major ritual impurity (junub), or by a member of the People of the Book6 is valid; the slaughter of an apostate is not.

(6) If both of a person’s parents are People of the Book, the meat he slaughters is lawful; but if either parent is not, it is unlawful. Likewise, anyone who converts from a group whose slaughter is impermissible to the religion of the People of the Book may lawfully slaughter, as stated in al-Iqnaʿ, chapter “Rulings on Dhimmis.” Yet the same author categorically rules in the Book of Marriage that marrying such a person is invalid, which creates a certain inconsistency. Lubdi, marginal note, p. 422.
