Dalīl al-ṬālibMarʿi al-Karmi

No amputation is carried out in a year marked by famine and exorbitant prices.

Whenever the requisite conditions are fulfilled1, the thief’s right hand is severed at the wrist, after which it must, by law, be plunged into boiling oil. It is recommended—should the imam deem it appropriate—to hang the severed hand around the offender’s neck for three days.

If he reoffends, his left foot is cut off at the ankle joint, leaving the heel intact. Should he relapse once more, no further cutting2 is performed; rather, he is imprisoned until he dies or repents.

The physical punishment does not cancel financial liability: he must return what he took3 to its owner and repair whatever damage he caused to the ḥirz. He is also responsible for the executioner’s fee and the cost of the oil.

(1) Manuscript N adds the word “hadhihi” (“this”). (2) Manuscripts M and N read “lam yuqtaʿ” (“he is not to be amputated”). (3) Manuscript M reads “akhadha” (“took”).
