Chapter: The ḥadd for Intoxicants
Whoever drinks a liquid intoxicant, snuffs it through the nose⁴, administers it as an enema⁴, or eats dough kneaded with it⁵—even if it fails to intoxicate him—incurs a ḥadd of eighty lashes if he is free⁶ and forty if he is a slave.
This penalty is applied provided that the offender is a Muslim, legally responsible, acting by choice, and aware that a large quantity of the substance is intoxicating.
Anyone who imitates wine-drinkers in their gatherings or in the vessels they use commits a forbidden act and is disciplined with taʿzīr.
Likewise, fruit juice becomes unlawful⁷ once three days have elapsed without being boiled.
(4) Manuscript M adds the word "bihi"; manuscript N inserts it into the commentary.
(5) Manuscripts J, M, and N read "wa-law" instead of "aw lam".
(6) Al-Insaaf, 10/229, affirms that this is the authoritative position adopted by the majority of Hanbali scholars.
(7) The word "yahrumu" is absent from manuscript A.
