Diya for Functional Faculties
A full diya is required for eliminating any of the following faculties: hearing, sight, smell, taste, speech¹, intellect, memory, and the capacities of walking, sexual intercourse, eating, voice, or grasping.
If² someone frightens a person or strikes him so that he involuntarily passes feces, urine, or wind³, he must pay one-third of the diya as long as the condition does not persist; should it persist, the full diya is due.
(1) For the loss of speech, the indemnity is calculated proportionally, being divided among the twenty-eight letters of the Arabic alphabet. Hashiyat al-Labbadi, p. 386.
(2) The manuscript designated “M” reads wa-min (“and from”).
(3) The manuscript designated “N” reads aw bi-bawl, aw bi-rih (“or by urine, or by wind”).
