Istibrāʾ is only deemed valid after the buyer’s ownership of the slave-girl is fully and completely established, even if he has not yet taken physical possession of her; and if he acquires her while she is menstruating, that particular period does not count.

If1 he comes into possession of a woman who is already required to observe a waiting period (ʿidda), that ʿidda is sufficient.

Should an inherited slave-girl claim that intimacy with the heir is forbidden to her because the deceased owner had intercourse with her, or should a purchased slave-girl claim that she has a husband, her statement is accepted.
