Dalīl al-ṬālibMarʿi al-Karmi

If he is unable to fast because of advanced age or a chronic illness from which recovery is not anticipated1, he must feed sixty needy Muslims2, giving each person one mudd of wheat or half a sâʿ of any other staple; bread, or anything that would not be acceptable for the al-fiṭr obligation3, is insufficient. Emancipation, fasting, and feeding are all valid only when accompanied by the requisite intention4.

1 The author’s wording is as stated, yet the authoritative Hanbali position is that the expiation is valid even when the slave’s recovery is still hoped for; cf. Tanqih, p. 249; Tawdih, p. 360; Iqnaʿ, 4/93; Muntaha, 2/331; Ghayah, 3/189, and Hashiyat al-Labadi, p. 242. 2 The term “Muslim” does not appear in manuscripts A, C, M, or N. 3 Hashiyat al-Labadi, p. 342: “If the five standard staples are unavailable, any food normally consumed—such as grain or dates—may be given, as already noted under zakat al-fitrah.” 4 Manuscript N adds the phrase: “nor feeding.”
