Section on Time-Conditioned Divorce1

If a husband says, “You are divorced yesterday,” or “before I married you,” and he intends by those words to bring the divorce about, it takes effect; otherwise it does not.

Should he say, “You are divorced today if tomorrow comes,” the statement is meaningless and no divorce occurs.

If he declares, “You are divorced tomorrow, or on such-and-such a day,” the divorce is effected on whichever of the two days arrives first, and in the eyes of the law his later claim—“I meant the later day”—is not accepted.2

If he says, “You are divorced in tomorrow, or in the month of Rajab,” it likewise takes effect with the first of the two periods to commence; yet if he claims, “I intended the later period,” his claim is accepted in court.

“You are divorced every day” counts as a single divorce only.

“You are divorced in every day” entails one divorce for each day.

“You are divorced when a month has elapsed” is realised after thirty days have passed, whereas “when the month has elapsed” is realised upon the completion of that particular month. The same applies to “when a year has elapsed” and “when the year has elapsed.”

(1) Manuscript M adds the words “the past and the future,” and manuscript N incorporates this addition into the commentary. Al-Lubadi, in his marginalia (p. 397) on the term “al-zaman” (time), notes that it covers the past, future, and present, making it preferable to the wording in al-Muntaha and al-Iqna. (2) Manuscript A reads “idha” (if).
