Chapter on Marital Cohabitation
Each spouse is obliged to treat the other honorably, maintaining pleasant companionship, refraining from harm, and not delaying the fulfillment of the other’s rights.3
The husband’s right over his wife is greater than her right over him.
He should exercise protective jealousy, but without excess.
When4 the marriage contract has been concluded, the woman must, upon his request, present herself in her husband’s home, provided she is free and capable of marital intimacy—as in the case of a girl of nine—unless she had stipulated that she remain in her own dwelling.
She is not obliged5 to comply if he summons her while she is in ihram, ill, too young, or menstruating, even if he says, “I will not have intercourse.”
(3) Manuscript “A” reads: bi-haqq (“by right”).
(4) Manuscript “Alef” reads: fa-idha (“then, when”).
(5) Manuscript “Nun” reads: fa-la yajibu (“so it is not obligatory”), explicitly retaining the particle fa-.
