Dalīl al-ṬālibMarʿi al-Karmi

And the child of a female mudabbira1 born after the declaration of tadbīr shares her ruling.

The owner may lawfully have intercourse with her even if he did not stipulate2 that right, and—where the law allows—with her daughter as well.

If a mudabbir, an ordinary slave (qin), or a mukātab owned by a non-Muslim embraces Islam, the master is compelled to relinquish ownership3; should he refuse, the slave is sold against his will.

(1) Manuscript M reads al-ama (the slave woman) instead of al-mudabbara. (2) Manuscript N has the variant yashtratuhu. (3) Manuscript M adds the word anhu, which the editor of N has incorporated into the commentary.
