Whenever the prescribed shares do not ⦗3⦘ exhaust the estate and no residuary heir exists, the remaining surplus is returned to every fixed-share heir in proportion to that share—except for the husband and the wife, for no surplus is returned to either of them on the basis of marriage. If a single fixed-share heir is the only beneficiary, that heir receives the whole estate, partly as a statutory share and partly as radd. And if there are several of
