If a waqf is made in favor of his children and1 the children of another person, only those already alive at the moment of dedication are included—male and female2 alike, sharing equally with no preference; beyond them, only the descendants through sons are admitted.
If, however, he says3 “for my children,”4 his children who exist at the time, together with any offspring born to them, are included, but not any new children5 he himself may father later. If he says, “for my children and for those who will be born to me,” both the existing and the future children are covered, the latter following the former.
When the endowment is made for his ʿuqb (posterity) or6 his nasl (progeny), or for his grandchildren, or for his dhurriyyah (seed), both males and females enter, but not the descendants of daughters unless a specific indication dictates otherwise.
If he dedicates it to his banī or to the banī of So-and-so, the benefit is restricted to males alone.
In this sphere it is disliked to favor some of one’s children over others without a valid reason, and the Sunnah is not to give a male more than a female. Yet, if one of them has dependents, is in need, unable to earn, if he singles out those engaged in the pursuit of knowledge, or those known for piety and uprightness, there is no objection7.
