Chapter on Leasing (ijarah)
Its conditions are three:3 (1) the benefit must be precisely identified, (2) the rent must be precisely identified, and (3) the benefit must be lawful to take while the leased item itself remains intact.
Accordingly, any item whose substance endures while its benefit is enjoyed may be leased, provided that the benefit can be measured by the work to be done—such as riding4 an animal to a specific destination5—or by a set period of time, however long, so long as it is predominantly expected that the item will still exist when that period ends.
(3) In manuscript N the phrase appears as "wa shurutaha" (and its conditions), with the conjunction waw added.
(4) Manuscript A reads "karkubah".
(5) Manuscript A reads "ila mahal" (to the place).
