Chapter on Selling Fixed Property and Fruits.
Whoever2 sells, gifts, pledges, endows, acknowledges, or bequeaths a house, the transaction encompasses its land, its structure, and its courtyard3, along with whatever is attached to it for its utility—such as stairways, nailed-on shelves, fitted doors, buried storage jars, and any trees or arbors it contains—but not buried treasure or stones4, nor anything that is detached5.
(2) Al-Lubadi notes in his marginal commentary (p. 184): “The word min is a conditional particle functioning as the subject; the verb tanaawala serves as the apodosis, and the whole clause acts as the predicate. The pronoun it contains refers to sale, gift, pledge, endowment, acknowledgement, and bequest—all drawn from baaʿa (to sell) and the items coordinated with it. Consequently, the predicate clause lacks an explicit link with the subject, unless one understands the meaning as ‘his sale’s encompassing of it, or his gift, etc.’ In that case the link is an implied pronoun, as in the expression ‘al-samen manwaan bi-dirham’ (‘clarified butter—two measures of it for one dirham’), where the link is implicit in the phrase.”
(3) Al-Iqnaaʿ and al-Muntahaa state explicitly that the courtyard (al-finaʾ) is included in the ownership of the house. Al-Wazir adds: “The jurists agree that when someone sells a house, he may not then sell its courtyard separately; if he does, the sale of the courtyard is void.” See Hashiyat al-Rawd, vol. 4, p. 531.
(4) In manuscripts M and N the reading is “kanzan wa hajaran” (“a treasure or a rock”).
(5) Manuscript N adds the word “ʿanha” (“from it”).
