and,1 with respect to a female slave, that she be a virgin or that she has begun to menstruate; and, for a riding beast, that it be smooth-gaited2, milk-giving, or pregnant; and, for a cheetah or a falcon, that it be trained for the hunt. If the stipulated quality3 is present, the sale is binding; if not, the buyer may annul the contract because the quality is lacking4.
It is also valid for the seller5 to stipulate that he retain a defined benefit from the item sold—for example, to live in the house for one month6 or to have the animal carry loads to a specified place. Likewise, the buyer may stipulate that the seller transport the purchased goods, break them up, sew them, or tailor them.
Section
An invalid condition that nullifies the sale is one that makes the contract dependent on another sale, a loan, a debt, a lease, or a partnership; or on converting the price into currency, which is the forbidden “two sales in one.” The same applies to anything of that nature, such as, “Marry me your daughter,” or,7 “I will marry you my daughter,” or,8 “Provide for my slave or my mount.”
