Sixth: Both the price and the item being sold must be known—either through a precise description or by direct inspection1 at the moment of the contract or shortly beforehand.
Seventh: The contract must take immediate effect, not be suspended on a condition such as, “I sell this to you when the first of the month comes” or2 “if Zayd is pleased.” The wording “I have sold and accepted, God willing,” is, however, valid.
Whoever sells one determinate item together with another that is indeterminate yet whose particulars can still be ascertained, the sale is valid for the determinate item in proportion to its share. But if the indeterminate item cannot be identified3 and the price of the determinate item was not specified, the entire contract is void.
Section
It is forbidden—and invalid4—to buy or sell inside a mosque, or by anyone obliged to attend the Friday prayer once the call is made at the pulpit; the same ruling applies when the time for an obligatory prayer is about to expire. It is likewise impermissible to sell grapes or5 must to someone who will make wine, to sell eggs, nuts, and similar items for gambling, or to sell weapons during civil strife, or6 to belligerents or bandits.
