Chapter on the Fidya
The fidya is the compensation that becomes obligatory because of a violation committed while in a state of ihram or within the Sacred Precinct.
It is of two kinds: one in which the pilgrim may choose among several options, and one that must be followed in a fixed sequence.
-
The discretionary fidya: This applies to the penalties for wearing fitted clothing, using perfume, covering the head, removing more than two hairs or⦗1⦘ two nails, ejaculating merely by looking, or engaging in sexual contact short of full intercourse with ejaculation. In any of these cases the pilgrim may choose between: (a) slaughtering one sheep; (b) fasting three days; or (c) feeding six needy persons, each of whom receives one mudd of wheat or half a sâʿ of any other staple. The same rule of choice applies to compensation for hunting: he may either offer a like animal from livestock, or assess the value of that equivalent at the place where the game was killed, purchase with that amount food acceptable for the zakat al-fitr, and give every needy person one mudd of wheat or half a sâʿ of something else, or else fast one day in place of feeding each needy person.
-
The sequential fidya: This includes the sacrifice due from a pilgrim performing tamattuʿ, one performing qirān, the penalty for omitting an obligatory act, the fidya for being prevented (iḥṣār), and the expiation for intercourse and similar acts. Any pilgrim performing tamattuʿ or qirān, or anyone who has neglected an obligation, must offer a sacrificial animal (dam). If he cannot obtain the animal or its price, he is to fast three days during the pilgrimage—the best arrangement is for the last of them to be on the Day of ʿArafah, and fasting during the Days of Tashrīq is also valid⦗2⦘—and seven more days when he returns home.
A pilgrim who is prevented (muḥṣar) must likewise offer a sacrificial animal; if he cannot find one⦗3⦘ he fasts ten days and then releases himself from ihram. Whoever has intercourse during Hajj before the first release from ihram, or ejaculates semen through foreplay, masturbation, kissing, touching with sexual desire⦗4⦘, or through repeated gazing, must offer a camel (badana).
