7- Ruling regarding the children of a man who abandons the prayer when he has married a Muslim woman:
With respect to the mother, they are unquestionably her children in every circumstance.
With respect to the husband, the verdict varies according to the two legal positions on whether the one who abandons the prayer is deemed a disbeliever.
– According to those who do not consider him an unbeliever, the children are fully affiliated to him, because the marriage itself is valid.
– According to those who do consider him an unbeliever—and this, as established in Chapter One, is the correct view—we distinguish two situations:
-
If the husband is unaware that the marriage is invalid, or does not believe it to be invalid, the children are attributed to him. In his estimation the intercourse was permissible, so it is treated as watʾ al-shubhah (intercourse under a mistaken assumption of permissibility), and lineage is established in cases of watʾ al-shubhah.
-
If the husband knows the marriage is invalid and believes it to be so, the children are not affiliated to him, for they were conceived from the semen of a man who holds that his act of intercourse was forbidden, having taken place with a woman who was not lawful for him.
Secondly: The otherworldly rulings that follow from apostasy:
1- The angels will reproach and rebuke such people, even striking their faces and their backs. Allah Most High says:
“If you could but see when the angels take the souls of those who disbelieved, striking their faces and their backs and saying, ‘Taste the punishment of the burning Fire! That is for what your own hands sent on ahead, and Allah is never unjust to His servants.’” (Al-Anfāl 50–51).
